As I was leaving a bar around midnight five police cars surrounded me on the parking lot and I was arrested and taken to the police station for questioning. It turns out that the police had been staking out this bar for quite some time because they had a tip that illegal gambling and drug trafficking was taking place in the back room. I was busy trying to convince them that I didn�t even know there was a back room and I had simply stopped in for a beer and throw some darts. After an hour or so, I could see they were in no mood to believe what I was telling them and they were in the process of trying to sweat a confession out of me. I requested my phone call and contacted a San Diego Attorney. He told me he was on his way and would be there in 30 min. and not to give out any more information than I already had. Needless to say, my criminal defense attorney straightened out the whole matter. The whole incident occurred because I bare a close resemblance to the suspect that was under their surveillance. They had my car towed to impound and the CSI guys were taking it apart when the investigation was called to a halt. Thankfully, my dui attorney San Diego acted as quickly as he did because they would�ve had my car completely disassembled while searching for evidence. My criminal defense attorney complained to the prosecutor that my car should not of been searched until after it was determined whether or not I was the man they were looking for. So, it constituted an illegal search, since they didn�t find anything there was no seizure. The prosecutor�s office was therefore liable for having my car put back together properly. I was issued a formal apology from the police chief. All records of my arrest were expunged from the record and I was not charged a toll free or impoundment fee to recover my car.
